USPTO Cracks Down on Fraudulent Trademark Registrations

In an effort to preserve the integrity of the U.S. trademark system, the United States Patent and Trademark Office (USPTO) has initiated a review of multiple trademark registrations tied to fraudulent filings. This action stems from ongoing administrative sanctions proceeding against Seller Growth Network Tech. Co., Ltd. and others.

The USPTO's investigation, which began with Show Cause Orders in 2022 and 2023, uncovered widespread misconduct, including forged signatures and falsified application details. These deceptive practices led to improperly granted registrations, which now face reconsideration and possible cancellation.

Given the severity of the fraud, the USPTO has proposed the following measures:

  • Reopening affected application and post-registration proceedings

  • Canceling registrations that were obtained through fraudulent means

  • Enforcing stricter verification and compliance measures

Citing legal precedents such as Tokyo Kikai Seisakusho, Ltd. v. United States, 529 F.3d 1352 (Fed. Cir. 2008), the USPTO affirms its authority to revisit and correct registration decisions tainted by fraud.

Trademark owners impacted by this review must act promptly. The USPTO has set a deadline of March 26, 2025, at 11:59 PM ET for responses. Affected parties must:

  • Trademark Owners: Submit objections using the Petition to the Director form.

  • Respondents Named in the Order: Send a response via email to [email protected].

This move signals a broader USPTO initiative to combat fraudulent trademark filings. Businesses should anticipate increased scrutiny of applications and stricter enforcement of compliance measures moving forward.
